No instruction yet on fresh pardon application, says Najib’s lawyer

KUALA LUMPUR: Najib Razak’s lawyer said today he has yet to receive any instruction from the imprisoned former prime minister to submit a fresh application for a royal pardon.

Shafee Abdullah said Najib would decide on the next step after the appeals court decides on Monday about his application for a judicial review regarding a purported addendum to the Feb 2 pardons board decision to commute his sentence in the SRC International case.

He said that if a fresh pardon application was submitted, it would endanger Najib’s current application in his appeal to serve the remainder of his jail term under house arrest.

“But we are also prepared to bring the matter to the Federal Court if the leave for review is denied on Jan 6,” he told reporters here after a forum on royal pardons.

Najib is seeking a court order to compel the government to execute the supplementary order, if it exists, by placing him under house arrest.

The question of a fresh pardon application arose after the Attorney-General’s Chambers said last week that all pardon applications in Kuala Lumpur, Putrajaya and Labuan must be submitted to the Federal Territories’ Pardons Board.

On Friday, Istana Negara reiterated that any proposal for a prisoner to be granted a pardon or sentence reduction must be submitted to the pardons board for consideration. The palace also reiterated that pardons lie within the prerogative of the Yang di-Pertuan Agong.
