Ex-cop seeks A-G’s intervention over 2015 assault complaint against Shuhaily

KUALA LUMPUR: A former policeman has sought the Attorney-General’s intervention to revive an assault complaint lodged against Malaysian Border Control and Protection Agency director-general Datuk Seri Mohd Shuhaily Mohd Zain in 2015.
The move comes a week after Shuhaily was charged with two counts of voluntarily causing hurt to two police personnel at KLIA last month.
Lawyers Kamal Hisham Ja’afar and Muhammad Nor Tamrin said their client, Saifuddin Abdul Kader, lodged a police report against Shuhaily on Nov 19, 2015, when the latter was Hilir Perak police chief.
However, they claimed no action had been taken on the complaint.
“We received information from the public about a complainant who was allegedly assaulted by Shuhaily in 2015.

“Although a police report was lodged, no action has been taken against Shuhaily to date,” they said in a statement today.
According to the report, Saifuddin alleged that the incident occurred at 8.30am on Nov 17, 2015, while he was on guard duty at the Hilir Perak police headquarters.
He claimed Shuhaily reprimanded him for failing to salute him before repeatedly scolding him in front of other police personnel.
Saifuddin also alleged that Shuhaily punched his left wrist during the confrontation and threatened to transfer him to Sabah or Sarawak and initiate disciplinary action against him.

The lawyers said their client believed he now had an opportunity to seek justice following the A-G’s decision to prosecute Shuhaily over the separate KLIA incident.
“Having seen the principle of equality before the law without discrimination demonstrated by the A-G in bringing charges against Shuhaily, Saifuddin believes he still has an opportunity to obtain justice under the current administration.
“We respectfully request that this case be reviewed and reconsidered to ensure that the rule of law continues to be upheld without discrimination,” they said.
On Oct 21, Shuhaily pleaded not guilty at the Sepang Magistrate’s Court to two charges of voluntarily causing hurt to two police personnel at KLIA on Sept 28.
Both charges were framed under Section 323 of the Penal Code, which carries a maximum jail term of one year, a fine of up to RM2,000, or both, upon conviction.
