PETALING JAYA: The Negeri Sembilan state administration will not proceed with menteri besar Ismail Lasim’s request to gazette the proclamation on the purported removal of Tuanku Muhriz Tuanku Munawir as Yang Dipertuan Besar.
In a statement, the state secretary’s office took note of the Attorney-General’s Chambers’ view that the proclamation dated April 19 was invalid because it did not comply with the mandatory requirements of Article 10 of the state constitution.
“Based on the entirety of the AGC’s statement dated Sept 17, the administration accepts (the AGC’s) advice and will not take any action to gazette or implement the proclamation as such action would be invalid and unconstitutional,” it said.
Earlier, Ismail endorsed a statement issued by his executive council on Wednesday that purportedly affirmed Tuanku Muhriz’s removal as Yang Dipertuan Besar.
He said the state secretary had been asked to proceed with gazetting the proclamation “according to the relevant regulations”.

However, the AGC later said that the proclamation by the four undangs was invalid as although they had the power to remove the Yang Dipertuan Besar, there was no evidence that the procedures laid out in Article 10 had been followed.
It also said the statement issued by members of the Negeri Sembilan executive council affirming the legitimacy of Tuanku Muhriz’s purported removal as Yang Dipertuan Besar had no legal effect as the exco members had no jurisdiction, authority or power under the state constitution to make such an announcement.
The AGC said the menteri besar and state executive council also did not have the power to unilaterally vacate the state ruler’s position.
The state secretary’s office said that the state administration accepted the AGC’s view on the exco members’ lack of jurisdiction.

“There is also no legal basis for the exco members’ reliance on the proclamation dated April 19 for their announcement,” it said.
