No comment, AG says to queries on Najib’s addendum

Attorney-General Dusuki Mokhtar declined to comment on whether the AGC received the house arrest addendum for former prime minister Najib Razak

PUTRAJAYA: Attorney-General (AG) Dusuki Mokhtar has sidestepped queries on whether the Attorney-General’s Chambers received the house arrest addendum for former prime minister Najib Razak.

“I will not comment,” he said on the sidelines of the opening of the legal year at the Putrajaya International Convention Centre here.

Najib’s lawyer Shafee Abdullah told the Court of Appeal on Monday that the addendum was sent by the palace on Jan 29, 2024 to then AG Ahmad Terrirudin Salleh.

Terrirudin, who was appointed as a Federal Court judge in November, was also at the opening of the legal year but evaded reporters.

On Monday, Najib obtained leave from the Court of Appeal to begin judicial review proceedings to compel Putrajaya to execute the addendum issued by the former king, allowing him to serve the remainder of his jail term under house arrest.

In the majority ruling, Justice Firuz Jaffril said Najib had written to six of the seven respondents named in the appeal seeking to confirm the existence of the purported addendum but received no reply from any of them.

The six respondents were the home minister, the prisons commissioner-general, the attorney-general, the Federal Territories Pardons Board (FTPB), the law and institutional reform minister, and the director-general of the Prime Minister’s Department’s legal affairs division.

Firuz said that Najib had, after the High Court hearing in July, obtained a copy of the addendum from the Pahang ruler, who was the 16th Yang di-Pertuan Agong.

The FTPB announced on Feb 2 last year that Najib’s prison sentence in his SRC International case had been halved from 12 years to six, and his fine reduced from RM210 million to RM50 million.

The former prime minister is currently serving his jail sentence at Kajang prison.

In his leave application filed in the High Court on April 1, he claimed that the former king, during an FTPB meeting on Jan 29, also issued a supplementary decree allowing him to serve the remainder of his reduced jail term under house arrest.

He said the FTPB had omitted to announce the terms of the supplementary decree, and that the government was in contempt for not complying with it.
