High Court defers verdict on ex-civil servants’ pension adjustment suit
PETALING JAYA: The High Court in Kuala Lumpur has deferred its judgment on a class action lawsuit led by pensioner Aminah Ahmad, seeking to compel the government to expedite adjustments to pensions in accordance with a previous court ruling.
Justice Amarjeet Singh said he needed more time to arrive at a decision and fixed Jan 16 next year to deliver his verdict, reported The Edge.
They said their clients, some of whom had travelled from Johor, were disappointed to hear about the adjournment.
Amarjeet, after hearing submissions from all parties, previously said he would deliver his decision today.

On Feb 29, the High Court granted Aminah and her co-applicants leave to commence judicial review proceedings after the Attorney-General’s Chambers (AGC) raised no objection.
The 56 retired civil servants filed their application on Jan 12, naming the government and director-general of the public services department as respondents.
They are seeking to compel the respondents to implement adjustments to their pensions in accordance with the formula prescribed in Sections 3 and 6 of the Pensions Adjustment Act 1980 (PAA) prior to amendments to the law made in 2013.
Under the old scheme, a retiree’s pension was to be revised based on the prevailing salary of incumbent civil servants in the same grade.
The 2013 amendment introduced a flat-rate annual increment of 2%.

Aminah lost her initial suit in the High Court in 2020.
However, the Court of Appeal overturned the decision, ruling that the amendments made to the PAA in 2013 were null and void as they had put the applicants in a less favourable position than previously, in breach of Article 147 of the Federal Constitution.
On June 27 last year, a five-member Federal Court bench upheld the Court of Appeal’s decision.
