Couple to be charged over alleged indecent act at Penang cemetery

GEORGE TOWN: A couple arrested in connection with an alleged indecent act at a Chinese cemetery here will be charged at the magistrate’s court tomorrow.

Northeast district police chief Assistant Commissioner Abdul Rozak Muhammad said the two individuals, aged 37 and 58, will be charged under Section 377D of the Penal Code.

The provision criminalises acts of “gross indecency” between persons, whether in public or private, and carries a penalty of up to two years’ imprisonment.

“The couple, held in connection with the case, will be charged under Section 377D of the Penal Code at the George Town magistrate’s court tomorrow,” he said.

Police had earlier obtained a three-day remand order against the pair.

They were allegedly caught on video engaging in an indecent act at a Chinese cemetery.

Both individuals have admitted to committing the act.

Police began investigations after receiving a report from a 69-year-old man regarding a video showing a man and a woman behaving inappropriately at the cemetery.

Initial findings showed the incident occurred on March 22 at the Batu Gantung Chinese cemetery in Air Itam.

The woman was arrested at 8.35pm on Monday at a flat near Jalan Padang Tembak, while the man was detained at 11.10pm in front of a building near Jalan Paya Terubong in Sungai Ara, Bayan Lepas.
