Govt reviews Sedition Act, Sosma

KUALA LUMPUR: The government is currently reviewing the Sedition Act 1948 as part of its broader legal reform agenda.

Home Minister Datuk Seri Saifuddin Nasution Ismail said the review demonstrates the administration’s commitment to implementing the reforms it has promised.

“The ministry is presently undertaking a review of the Security Measures (Special Measures) Act 2012 (Sosma) and the Sedition Act 1948 with the involvement of relevant stakeholders and various interest groups.

“This study reflects the government’s commitment in implementing the reforms promised,” he said in a written parliamentary reply.

He was responding to a question from Dr Kelvin Yii Lee Wuen (PH-Bandar Kuching).

On a separate matter, he said the government currently has no plans to remove the requirement for approval from a non-citizen father when applying for a child’s Malaysian citizenship under Article 15(2) of the Federal Constitution.

He said the requirement is not meant to complicate applications but serves as a critical security safeguard.

“This approach is taken to prevent complex legal implications in the future, particularly to protect the interests of the mother and child in the event of unforeseen circumstances.

“It ensures that a child’s citizenship status is not challenged in court or becomes the subject of international legal disputes in the absence of an official record showing the father’s consent,” he said.

He said the requirement also confirms the father’s agreement for the child to hold only Malaysian citizenship, helping to avoid conflicts with the father’s country of origin, as Malaysia does not recognise dual citizenship.
