PETALING JAYA: There is no intention on Putrajaya’s part to delay executing the Kota Kinabalu High Court’s order in its Oct 17 ruling to conduct a review with the Sabah government and determine the state’s 40% entitlement, says Bangi MP Syahredzan Johan.

The DAP man said it was clear from the federal government’s words and actions that it intended to fulfil its constitutional obligation and the court order.

“The government will not appeal the court’s finding about Sabah’s entitlement to 40% of its revenue. This means the ruling is not disputed.

“The federal and state governments are obligated to comply with the Kota Kinabalu High Court’s order,” Syahredzan said in a statement.

He noted that finance ministry secretary-general Johan Mahmood Merican’s letter, sent to the Sabah state secretary’s office to initiate negotiations, indicated Putrajaya’s compliance with the court’s specific order for the federal and state governments to conduct a review.

Syahredzan was responding to PKR’s Hassan Karim, who said earlier today that the federal government could not delay executing the court order by “saying you will negotiate it with the Sabah government”.

Criticising Putrajaya’s decision to appeal “defects” in the ruling’s grounds of judgment, the Pasir Gudang MP had said Prime Minister Anwar Ibrahim could not say the Cabinet only agreed with the 40% of revenue entitled to Sabah but disagreed with certain remarks made by the judge.

“We must understand that the judge’s verdict and the court judgment produced by the same judge are tied to one another.

“If the federal government is unhappy with the High Court’s verdict, then Putrajaya must file an appeal at the Court of Appeal (over the full judgment),” he said on Facebook today.

However, Syahredzan argued that Putrajaya had a right to appeal either the entirety of the ruling, or part of it.

“I respect Hassan as a lawyer and senior MP, but I feel obligated to answer his accusations. (The appeal) is not unusual or out of order, and Hassan knows this,” he said.

Syahredzan said the federal government felt there had been a mistake in the grounds of judgment, particularly in the finding that the federal and Sabah governments abused their power and violated constitutional obligations since 1974.

“This finding has great implications and makes way for, among others, court actions such as misfeasance in public office against federal and Sabah ministers since 1974.

“This is why the government feels it has to appeal the finding. In this case, the appeal would be limited solely to the finding in question. The other findings and the court order itself are not included,” he said.
