Najib Razak’s lawyer told the Court of Appeal that the house arrest addendum was sent by the Pahang palace to then AG Ahmad Terrirudin Salleh (right) on Jan 29, 2024.

PUTRAJAYA: Najib Razak will file an application to initiate contempt proceedings against former attorney-general Ahmad Terrirudin Salleh, the former prime minister’s lawyer Shafee Abdullah said today.

Shafee said the basis of the application was Terrirudin’s alleged failure to reveal the former king’s royal addendum allowing Najib to serve the remainder of his jail sentence under house arrest.

“According to the Prime Minister’s (Anwar Ibrahim) statement, Terrirudin received the addendum and passed it to the current Yang Di-Pertuan Agong.

“But this is wrong. Terrirudin can’t expect the current Agong to be the enforcer of the addendum,” he said at a press conference held at the Palace of Justice, adding that the contempt action would be filed by Friday at the latest.

Shafee told the Court of Appeal last month that the addendum was sent by the palace to Terrirudin on Jan 29, 2024.

Terrirudin, who was appointed as a Federal Court judge in November, previously evaded queries from reporters on the matter.

Prime Minister Anwar Ibrahim confirmed that the addendum was received by Terrirudin but said it was sent back to Istana Negara after Sultan Ibrahim became the 17th Yang di-Pertuan Agong.

Najib has obtained leave from the Court of Appeal to begin judicial review proceedings to compel Putrajaya to execute the addendum issued by the former king, allowing him to serve the remainder of his jail term under house arrest.

The Federal Territories Pardons Board announced on Feb 2 last year that Najib’s prison sentence in his SRC International case had been halved from 12 years to six, and his fine reduced from RM210 million to RM50 million.

The former prime minister is currently serving his jail sentence at Kajang prison.

Shafee went on to claim that during Terrirudin’s tenure as the attorney-general, the latter had not been honest.

“When we issued a show-cause letter to him much earlier, Terrirudin denied he was guilty (of any wrongdoing) and stated that he did not have a duty to disclose the information. As far as I’m concerned, it is a worse position,” said Shafee.
